Judicial Intervention in India (2021–2022): Constitutional Governance, Fundamental Rights, and the Expanding Role of the Supreme Court

Abstract

The Constitution of India establishes an independent judiciary entrusted with the responsibility of safeguarding constitutional supremacy, protecting fundamental rights, and ensuring that every organ of the State functions within the limits prescribed by the Constitution. Judicial intervention, therefore, is neither an extraordinary phenomenon nor an institutional anomaly; rather, it constitutes an indispensable mechanism through which constitutional courts preserve democratic governance and the rule of law.¹
