Strategies for Preventing and Dealing with Family Disputes from the Perspective of Iranian Jurisprudence and Law With Regard to the Islamic Lifestyle

Abstract

The family is considered the initial foundation of the formation of the social system in all human societies. The importance of the family in the holy law and law is such that it has been addressed in numerous verses of the Holy Quran, and also the legislator in the Constitution of the Islamic Republic of Iran has paid attention to the family as one of the most important units of the foundation of the Islamic society that constitutes a healthy society, and that all laws, regulations, and all planning must be approved in order to protect the sanctity of the family. However, today, the desire for progress and modernity in humans has caused individuals to suffer from intellectual, behavioral, and moral disorders. The purpose of this study is to investigate the effect of the Islamic lifestyle on preventing and dealing with family disputes from the perspective of jurisprudence and law. The research method is library-reference and analysis is in the form of content-qualitative analysis. The findings show that the Iranian legislator, by enacting strict laws, has taken steps to prevent family disputes and preserve the foundation of the family. Jurisprudential sources have also always emphasized the preservation of the marital relationship and have examined methods to prevent the breakdown of this relationship both before and after marriage. Since the Islamic lifestyle is based on religious thoughts and attitudes and on divine commands, it makes life more sustainable and can significantly prevent family disputes compared to the modern lifestyle.
