The Construction of Public Information Dispute Resolution as an Effort to Fulfill the Right to Information

Abstract

Access to public information is one of the human rights and guaranteed by the constitution. The state is obliged to provide access to public information, as long as it is not excluded. In practice, many public information disputes arise between information applicants and public bodies. Indonesia and South Korea are two countries that have implemented regulations regarding public information disclosure. The research will explain the comparison of public information dispute resolution in Indonesia and South Korea. The research results show that both countries have facilitated the resolution of public information disputes, both through litigation and non-litigation processes. This is to guarantee legal certainty and fulfill citizens' rights to public information.
